Hole-in-One Contest Official Rules & Regulations

1. CONTEST TIMING

Headstorm, LLC Presents Headstorm Hole-In-One Contest (the “Contest”) begins Thursday, September 30 at 1:00 pm. Central Standard Time (“CST”) and ends on Thursday September 30 at 6:00 p.m. Central Standard Time (“CST”) (the “Contest Period”). By participating in the Contest, each entrant (as defined below) unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Headstorm, LLC, 15455 Dallas Pkwy, Ste 300, Addison, TX 75001 (the “Sponsor”) and by Distinguished Prize Indemnity LLC (d/b/a Grand Prize Promotions/American Hole ‘n One) (hereafter referred to as “GPP/AHNO”), whose decisions shall be final and legally binding in all matters related to the Contest.  

2. CONTESTANT ELIGIBILITY

The Headstorm Hole-In-One Contest (“Contest”) is open to legal residents of United States or the District of Columbia (excluding Alaska and Hawaii) (“U.S.“) who sign up at https://23.21.72.15/hole-in-one-contest/ and are participants of the DFW Technology Invitational. Entrants must be 18 years of age or older as of their date of entry in this promotion in order to qualify. Additionally, golfers must be Amateur Golfers, defined as those who are considered Amateur golfers by the USGA Rules of Amateur Status on the date of the event. Those shots taken by Amateur Golfers, registered participants are considered Amateur golfers if they meet the USGA Rules of Amateur Status on the date of the event. Inactive members of any Professional Golf organization must submit for and been accepted as an Amateur by the USGA or required governing body to be considered an Amateur golfer. Professional Golfers and Touring Professionals are ineligible to win any hole-in-one prize(s). This includes 1. those shots taken by Club Professionals, which are defined as being a member of the PGA, LPGA or any person who holds or retains membership of any Professional Golf Association, no matter their status, including Apprentice memberships. 2. Those shots taken by Touring Professionals, defined as those who play or have played for prize money on the PGA Tour, LPGA Tour or any tour affiliated with Professional Golfers, including but not limited to Mini Tours. This includes Touring Professionals who are retired or inactive. All players must be officially registered competitors in the DFW Technology Invitational. This Contest is subject to federal, state, and local laws and regulations and void where prohibited by law. Headstorm’s employees, its subsidiaries, affiliates, suppliers, partners, advertising and promotion agencies, and directors (collectively the “Employees”), as well as members of an Employees’ immediate family and/or those living in the same household of Employees are ineligible to participate in the Headstorm Hole-In-One Contest. 

3. HOW TO ENTER

By participating in the Contest, each entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor and GPP/AHNO, which are final and binding in all matters related to the Contest.

Limit: You may only enter one (1) time. This Contest has a maximum of 128 participants, after which any additional entrants will not be eligible to win.

  • Complete the entry form with all required information.
  • Agree to the Official Rules and submit your entry. Once you submit your entry you will receive one (1) entry into the Contest.

Use of Data:

Sponsor and GPP/AHNO will be collecting personal data about entrants online, in accordance with each of their privacy policy. By participating in the Contest, entrants hereby agree to Sponsor’s and GPP/AHNO’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s and GPP/AHNO’s privacy policies.

If an entrant enters the Contest using his/her mobile device, messaging and/or data fees may apply. Other charges may apply (such as normal airtime and carrier charges as well as charges for wireless Internet access) and may appear on your mobile phone bill or be deducted from your prepaid account balance. An entrant should consult his/her wireless service provider’s pricing plan for details. Each entrant agrees to incur any and all charges demanded by his/her wireless carrier. Each entrant should also check his/her device’s features for capabilities and check the device manual for specific use instructions.

4. PRIZE

The main prize of this contest is $75,000 awarded by a check in the name of the Ace-Maker, which can then be redeemed as a vehicle through Lewisville Autoplex up to a $75,000 value.

5. FEES

The Ace-maker is responsible for all tax, tag, title and fees associated with the main prize.

6. WITNESSES

All Official Witnesses must be non-participants, age 18 or older and of good moral character, appointed by Sponsor or responsible Tournament Official as follows: For prize limits $20,001 to $100,000, two Official Witnesses are required. One should be positioned at the tee-off area and the other adjacent to the green, out of harm’s way. Having witnesses in these locations is the ideal scenario. IMPORTANT: If there is a failure to abide by minimum Official Witness requirements, the claim is subject for denial.

7. YARDAGES

On the Target Hole, Men and Women must shoot from the respective yardages: 187 yards for men; and 172 yards for women. The target hole will measure from the tee to the flagstick, no less than the specified yardage on this contract.

WARNING

Should a valid hole-in-one occur at a yardage found to be less than that specified in this Contract, then the applicable prize amount payable shall be prorated as follows: 

  • 1 to 25 yards less than the yardage of this Contract will incur a penalty of 4.0% against the prize value per yard short of specified yardage. If the main prize hole(s) stated in this Contract is determined to have played 25 or more yards less than contracted, the claim will be denied in full. Or;
  • In the event that the target hole(s) is played from less than 135 yards the claim will be denied in full. 

8. NUMBER OF SHOTS

For tournament play, each category of shots specified on this Contract permit a 5% variance, plus or minus (+ or -), without a change in the contract fee. Shot variance greater than 5% must be reported to GPP/AHNO prior to the tournament. Coverage fee adjustment will be billed or refunded after the event. IMPORTANT: The prize value will be prorated downward if a valid hole-in-one occurs and the number of shots has been understated by more than the allowed 5% variance.

9. MULLIGANS, PRACTICE SHOTS OR ADDITIONAL SHOTS

Only the first shot taken on the target hole(s) by each contestant during the calendar day stated on Page 1 is eligible to win the hole-in-one prize offered. Absolutely no additional shots of any kind are permitted on the target hole(s) by the same contestant on the same day from the same yardage. A golfer who is ’rounding out’ a foursome by taking an extra shot for the team is only eligible on his or her first shot. If an event is conducted where contestants play through the target hole more than once, the yardage for all subsequent shots must vary by a minimum of 15 yards longer or shorter than the shot prior and in no case may one specific yardage distance be repeated. Only the authorized number of shots (plus or minus the 5% variance as indicated above for tournament play) are specifically permitted during the stipulated round(s) of the named tournament on the date(s) listed in this contract. Mulligan is defined as tournament or player providing or purchasing a ‘do over’ or repeat of the previous shot. Mulligans may not be used to win prizes and are strictly prohibited. 

IN THE EVENT OF A HOLE-IN-ONE

11. CLAIM NOTIFICATION – MAIN PRIZE

Immediate telephone notice to 800-822-2257 or email [email protected] by the Sponsor, Tournament Director, or Golf Course to the Claims Department of GPP/AHNO must be reported no later than the first business day after the tournament. In the event of claim being submitted, GPP/AHNO will provide witness affidavits for the Ace-Maker, Official Witnesses, two Playing Partners, and the Club Pro to complete and return within 60 days of receipt. We also require both sides of the original (or clear photocopy) Ace-Maker’s scorecard and the original tournament pairings sheet (player roster), along with the raw unedited videotape recording (if applicable). Failure to return complete and accurate documentation within 60 days may result in claim denial.

12. CLAIM INVESTIGATION

Sponsor shall cooperate fully with any claim investigation by GPP/AHNO in its sole discretion. Affidavits and recorded statements will be required from each witness to certify that all terms and conditions outlined herein have been met. If deemed necessary GPP/AHNO may require the alleged Ace-maker, members of the Ace-makers group and the non-playing Witnesses to submit to a Polygraph examination by a licensed Polygrapher selected by GPP/AHNO and at their expense. Each person must pass his or her polygraph examination as judged by the administering examiner as a condition to GPP/AHNO’s obligation to pay the claim. 

13. DISPUTED CLAIMS

GPP/AHNO acts specifically on behalf of the Sponsor and specifically not as agent of any competitor in a tournament in which GPP/AHNO provides coverage. The Sponsor of this contract agrees that any dispute resulting from a claim submitted hereunder will be governed by the laws of the State of Georgia and will first be submitted to binding arbitration in compliance with the rules established by the American Arbitration Association. If no agreement is reached through arbitration and if there is litigation with Grand Prize Promotions/American Hole ‘n One and / or Everest National Insurance Company pertaining to the claim, it shall be resolved solely and exclusively in an appropriate court in Gwinnett County, Georgia. By causing GPP/AHNO to issue this Contract, the Sponsor of this Contract agrees that it is subject to the personal jurisdiction of that court and to that venue as the exclusive one for all litigation arising out of the issuance of this Contract.

14. HOLD HARMLESS

Sponsor agrees to defend, protect, indemnify and hold harmless GPP/AHNO from any and all claims or causes of action brought by the alleged Ace-Maker or Tournament Committee, arising out of the issuance of this Contract, including the fees of counsel selected by GPP/AHNO to defend such action.

15. PRIVACY

Grand Prize Promotions/American Hole ‘n One will not release any information regarding this contract to any other parties other than Sponsor unless authorized by Sponsor. The names and likeness of Sponsor and Ace-Maker may be used by GPP/AHNO for promotional purposes without further compensation to the Sponsor or Ace-Maker.
